Congratulations to our client, a Financial Manager / Controller, on the approval of their EB-2 National Interest Waiver (NIW) and Green Card!
Our client holds the foreign equivalent of a U.S. Master’s Degree in Finance and has over 20 years of progressive experience at Unilever, where he played a key role in launching innovative and critical projects and initiatives across Europe and the United States.
This case faced significant challenges early on. After receiving a Request for Evidence (RFE), the petition was initially denied, with USCIS alleging that an EB-1C visa would have been the more appropriate category. However, because Unilever was not willing to sponsor the case and the client wished to self-petition, we determined that the EB-2 NIW was the correct legal strategy.
Importantly, there is no legal requirement that a beneficiary must pursue permanent residence through EB-1C simply because they are in the United States in L-1 status.

The adjustment of status process took approximately six months, and a routine in-person Green Card interview was scheduled.
